These Terms of Service ("Terms") govern your use of the Transform by Fitaz app and website, owned and operated by Fitaz Health PTY LTD ("we", "our", "us"). By accessing or using our services, you agree to be bound by these Terms.

SECTION 1 – OVERVIEW

By visiting our site or using our app, you engage in our "Service" and agree to be bound by these Terms, including additional terms and policies referenced herein. These Terms apply to all users of the Service.

SECTION 3 – ACCOUNT REGISTRATION

SECTION 4 – SUBSCRIPTIONS AND BILLING

Your subscription will automatically renew unless you cancel it before the end of the current billing cycle. You can manage or cancel your subscription through your app store provider (Apple App Store or Google Play Store). You are responsible for all recurring charges until cancellation is confirmed.

Transform by Fitaz uses a recurring billing model managed by Loop Subscriptions to offer ongoing access to our programs and exclusive content. When you subscribe, you agree to recurring charges on a monthly, quarterly, or annual basis, depending on your selected plan. Pricing and terms of Loop-managed subscriptions are clearly stated at the time of purchase.

Loop Subscriptions may provide features such as billing reminders, skip-a-month options, or renewal notifications. However, it remains the user’s responsibility to cancel or modify subscriptions ahead of the billing cycle.

No refunds are provided for partial billing cycles or unused time, except where required by law or at our sole discretion.

SECTION 5 – MODIFICATIONS TO THE SERVICE AND PRICES

We reserve the right to modify or discontinue the Service (or any part thereof) without notice. Prices are subject to change without notice.

SECTION 6 – PRODUCTS OR SERVICES

Certain products or services may be available exclusively online. We reserve the right to limit the sales of our products or services to any person, geographic region, or jurisdiction.

SECTION 7 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate purchase and account information for all purchases made through our platform.

We reserve the right to terminate your use of the Service at any time for violations of these Terms.

These Terms constitute the entire agreement between you and us regarding the Service.

These Terms are governed by the laws of Queensland, Australia.

If you subscribed through your app store, all billing inquiries, cancellations, and refunds must be handled directly through your app store account.

As with any fitness or exercise program, you assume certain risks to your health and safety by participating in programs offered by Transform by Fitaz (a product of Fitaz Health PTY LTD). Physical exercise, in all of its forms and with or without the use of equipment, is a strenuous physical activity. Accordingly, you should consult with your physician or other health care professional before starting this or any other fitness program.

By using our services, you acknowledge that you do so voluntarily and at your own risk. There is a risk of injury when participating in any exercise or fitness program. While we provide detailed instruction on proper form and technique, we cannot guarantee that you will not be injured. Injuries may occur if exercises are performed incorrectly, particularly without proper warm-up, cool-down, and attention to form.

Transform by Fitaz, Fitaz Health PTY LTD, and its affiliates, agents, employees, contractors, or representatives disclaim any liability for injuries, health issues, or damages sustained in connection with the use of our services, content, or programs. Participation in any fitness activity is entirely at your own risk.

If you experience faintness, dizziness, pain, or shortness of breath at any time while exercising, you should stop immediately and seek medical attention.

SECTION 23 – USER RESPONSIBILITY

You acknowledge and agree that it is your responsibility to ensure that any activities you undertake via the Transform by Fitaz program are suitable for your current fitness level and personal circumstances. You are responsible for understanding and following the guidance provided and for listening to your own body. If in doubt, seek professional advice.

Any testimonials, before-and-after transformations, or success stories featured on our homepage or product pages are individual results and are not guaranteed. Your results may vary based on personal effort, consistency, genetics, and lifestyle. Information provided is not a substitute for professional medical advice. Always consult your physician before beginning any fitness program.

7-Day Free Trial Terms

Transform by Fitaz may offer a 7-Day Free Trial to new users, allowing access to the digital app experience at no cost for a limited time. To begin the trial, users must provide valid payment information at the time of sign-up. No charges will be made during the 7-day trial period. Unless cancelled before the trial ends, your subscription will automatically convert to a paid 3-month subscription at the current rate of $127 AUD, and the payment will be processed using the payment method provided.

The 7-Day Free Trial is available to first-time users only. Transform by Fitaz reserves the right to revoke access to the free trial if it is determined that the user has previously redeemed a free trial offer under a different account or email address.

Users may cancel at any time during the trial period to avoid being charged. Once payment has been processed following the trial, no refunds will be issued, but access to the subscription will continue for the full duration of the paid period.

No physical products or equipment are included with the trial. Transform by Fitaz is a digital service only, and all equipment required for workouts must be purchased separately.
