These Terms and Conditions apply to the use of the TRANSFORM by Fitaz mobile application (App), the website at www.fitazfk.com (Website), and the associated fitness and nutrition products and services (Fitness Products), which are owned and operated by Fitaz Health PTY LTD ABN 62 169 230 040.
By accessing and using our Website, App, and Fitness Products, you agree to comply with these terms. We reserve the right to amend these terms from time to time, and your continued use of the App or Website will indicate your acceptance of any updated terms.
1. Fitness Products and Services
1.1 TRANSFORM by Fitaz offers a variety of general fitness programs designed to meet weight loss or fitness goals, which are promoted through the App and Website.
1.2 Our programs do not offer face-to-face personal training or individually tailored exercise or nutrition advice. All programs are general in nature and do not take into consideration individual health conditions, including pregnancy or medical concerns.
1.3 You must consult with a healthcare professional before starting any fitness or weight loss program, particularly if you have any health conditions, are pregnant, or are breastfeeding.
1.4 TRANSFORM by Fitaz does not guarantee any particular results from participation in our fitness programs.
2. Program Access, Compatibility, and Duration
2.1 Programs purchased through TRANSFORM by Fitaz are accessible exclusively via the App and www.fitazfk.com website, which is compatible with Android and iOS 14+ devices. If the app is not compatible with your device, a refund may be issued for the program, but not for any associated equipment unless returned in accordance with our refund policy.
2.2 Fitness programs offer varying access periods, which will be specified at the time of purchase. Regardless of the program's duration, the access period commences from the date of purchase. After the access period expires, continued access will require a separate purchase or subscription renewal.
2.3 No extensions on programs will be provided for any reason, including failure to start the program, illness, or personal circumstances. However, you may opt-in for extended month-to-month access at a discounted rate, cancellable at any time.
3. Refund Policy
3.1 TRANSFORM by Fitaz offers a 7-day cooling-off period, during which you can switch to another challenge at no additional cost. No refunds are offered on any programs, services, supplements, apparel, or equipment after this period.
3.2 If the App is not compatible with your device, we will refund the program cost. However, if equipment was purchased along with the program, the equipment must be returned to receive a full refund. Refunds are processed once the returned item is received at our facility.

4. Registration and Account
4.1 Users must be at least 18 years old to create an account and purchase Fitness Products.
4.2 Upon purchasing a program, TRANSFORM by Fitaz grants you a limited, non-exclusive, non-transferable, and revocable licence to use the program materials for personal, non-commercial purposes.
4.3 You may not share access to any programs or allow third parties to use your account.
5. Payments
5.1 All payments for Fitness Products must be made at the time of purchase via credit card, PayPal, or through in-app purchases facilitated by the Apple App Store or Google Play Store.
5.2 External app purchases made via third-party platforms are subject to the terms and conditions of the respective app store. Any payment-related issues must be addressed with the app store provider directly.
6. Apparel, Equipment, and Supplements
6.1 TRANSFORM by Fitaz does not offer refunds for change of mind on apparel, equipment, or supplements.
6.2 Exchanges are only permitted for faulty products or if the wrong size was received. We do not offer refunds, but we will honour exchanges in these cases. If you receive a faulty product, you must submit photographic evidence within 14 days of receipt to support@fitazfk.com. Once the fault is confirmed, we will process an exchange after the item is returned to us.
6.3 Customers are always responsible for the shipping costs when returning items, regardless of the reason for the return, including faulty items.
7. User Responsibilities
7.1 By registering an account or using the App, you agree that you:

7.2 TRANSFORM by Fitaz reserves the right to terminate your account or program access without refund in the event of unauthorised account sharing, misuse of materials, or other violations of these terms.
8. Limitation of Liability
8.1 To the fullest extent permitted by law, TRANSFORM by Fitaz will not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our App, Website, or Fitness Products, including but not limited to damages for loss of data, loss of profits, personal injury, or business interruption.
8.2 We are not responsible for any physical or mental injury, illness, or health condition that may result from using our fitness programs, as users participate at their own risk and are encouraged to seek medical advice before commencing.
9. Alternative Dispute Resolution
9.1 In the event of any dispute arising out of or in connection with these Terms and Conditions, the parties agree to first attempt to resolve the dispute through good faith negotiations.
9.2 If the dispute cannot be resolved through negotiation, either party may refer the dispute to mediation, conducted by a mediator mutually agreed upon. If mediation does not result in a resolution, the dispute may be referred to arbitration or litigation as a last resort.
9.3 The costs of mediation or arbitration will be shared equally between the parties unless otherwise agreed.
10. Privacy and Communications
10.1 We are committed to protecting your privacy and will handle your personal information according to our Privacy Policy.
10.2 By using our services, you consent to the collection and use of your personal information for the purposes of delivering our Fitness Products and communicating with you about our offerings.
10.3 We may contact you via email, SMS, or other methods to inform you about important program updates, new services, or promotions. You can opt-out of communications by following the instructions in our messages.
11. Jurisdiction
11.1 These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Queensland.
12. User Consent
12.1 By registering an account, purchasing Fitness Products, or using the App or Website, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
13. Extended Access
13.1 Extended Access is an optional subscription that allows continued access to programs you have previously purchased on your account. It does not grant access to any new programs that you have not already purchased. This is not a way to bypass purchasing a program.
13.2 For new customers, Extended Access will be automatically added to their cart when purchasing Level 1, 2, 3 & Express programs.
13.3 After the initial free period, Extended Access will automatically convert into a paid subscription unless cancelled before the next billing cycle.
14. In-App Purchases
14.1 You can purchase Transform by Fitaz programs through the Apple App Store or Google Play Store.
14.2 In-App purchases are subject to the terms and conditions of the respective platform provider. Transactions are securely processed through the payment gateway of the App Store or Play Store.
14.3 For any billing or payment-related issues, you must contact the respective App Store provider directly.
14.4 In-App purchases are not eligible for promotions, discounts, or affiliate discount codes. To apply any discounts or use affiliate codes, you must complete your purchase on the Transform by Fitaz website at www.fitazfk.com.
15. Complaints
15.1 Customers may make a complaint by email to support@fitazfk.com.
15.2 Customers must use the subject line "Complaint" in the email and provide a detailed outline of the complaint, including the nature of the complaint. Any supporting documentation should also be attached.
15.3 Transform by Fitaz will investigate the complaint and aim to respond within 14 Business Days.
